John F. Henry is an eminent economist who has made important contributions to heterodox economics drawing on Adam Smith, Karl Marx, Thorstein Veblen, and John Maynard Keynes. His historical approach offers radical insights into the evolution of ideas (ideologies and theories) giving rise to and/or induced by the changes in capitalist society. Essays collected in this festschrift not only evaluate John Henry's contributions in connection to Marx's and Veblen's theories, but also apply them to the socio-economic issues (...) in the 21st century. In Part I leading heterodox economists in the traditions of Marxism, Post Keynesianism, and Institutionalism critically examine Marx's and Veblen's theoretical frameworks (and their connections to each other) that have become the foundations of heterodox economics. The doctrine of precedent, as it has evolved within the common law, has at its heart a form of reasoning—broadly speaking, alogic—according to which the decisions of earlier courts in particular cases somehow generalize to constrain the decisions of later courts facing different cases, while still allowing these later courts a degree of freedom in responding to fresh circumstances. Although the techniques for arguing on the basis of precedent are taught early on in law schools, mastered with relative ease, and (...) applied on a daily basis by legal practitioners, it has proved to be considerably more difficult to arrive at a theoretical understanding of the doctrine itself—a clear articulation of the underlying logic. A key philosophical feature of Peter Jackson’s film interpretation of J.R.R. Tolkien’s The Lord of the Rings is its use of fantasy to inspire a “recovery” of the actual or, in other words, a reawakening to the beauty of nature and the many possible ways of living in healthier ecological relation to the world. Though none of these ways is perfectly achieved, this pluralistic view is demonstrated in the various lifeways of Hobbits, Elves, Men, and Ents. All of the positive (...) relationships embodied in the films—to trees, mountains, horses, and vegetable gardens—involve loving care and attention, receiving nourishment and livelihood without instrumentalization, or reducing nature to mere resource. The films also vividly display a variety of ugly and destructive ways of using the land to accrue power and wealth. These noxious ways, specifically because they actively destroy the lands that they use, always need more. They will thus eventually annihilate the beautiful ways of being if they are not actively resisted. Some of those who would rather be tending their own trees, gardens, or horses or even wandering in the wild forests must therefore turn their attention to struggle and resistance instead. This is a struggle full of grief, and at times even verging on despair, but it is marked by the refusal to give up hope. Indeed, what Jackson and Tolkien have to say about hope is as important in responding to the ecological crisis as anything they have to say about nature, inasmuch as they help to remind us that even in our own times, “there is still hope.”. In this essay, I examine the structure and language of More's letter to William Gonell, the tutor to More's children, so as to understand what More takes to be most important in the education of his children. Indeed, the circumstances of the letter's composition suggest that More writes in reply to Gonell's objection to More's educational directives. More's reply from court suggests that he viewed Gonell's opposition as a family crisis that required More to articulate his fundamental principles of humanist (...) education. (shrink)

This paper points out some problems with two recent logical systems – one due to Prakken and Sartor, the other due to Kowalski and Toni – designedfor the representation of defeasible arguments in general, but with a specialemphasis on legal reasoning.

This paper describes one way in which a precise reason model of precedent could be developed, based on the general idea that courts are constrained to reach a decision that is consistent with the assessment of the balance of reasons made in relevant earlier decisions. The account provided here has the additional advantage of showing how this reason model can be reconciled with the traditional idea that precedential constraint involves rules, as long as these rules are taken to be defeasible. (...) The account presented is firmly based on a body of work that has emerged in AI and Law. This work is discussed, and there is a particular discussion of approaches based on theory construction, and how that work relates to the model described in this paper. (shrink)

An acceptable empiricist account of laws of nature would havesignificant implications for a number of philosophical projects. For example, such an account may vitiate argumentsthat the fundamental constants of nature are divinelydesigned so that laws produce a life permittinguniverse. After some preliminary clarifications, arguments for the supposed asymmetry of supervenience and determination, such as they are, are shown to be unsound. An argument against the supposed asymmetry is then constructed and defended against objections. This is followed by explanations of why the intuition of asymmetry is nonetheless so entrenched, and of how the asymmetric ontological priority of the physical over the non-physical can be understood without the supposed asymmetry of supervenience and determination.

The material to follow challenges the conceptual uniqueness and contribution of the content of the field of marketing ethics. Based on a comprehensive inspection of the marketing ethics literature, this "review note" (an uncommon genre of academic manuscript – a briefly-presented review highlighting a specific point) concludes that, in terms of pragmatic behavioral guidance as well as conceptual content, marketing ethics has nothing new nor distinctive to offer. Though an initially unexpected conclusion, perhaps, explanation is provided for why marketing ethics' (...) absence of contribution is perfectly natural and appropriate. Evidence also is found to establish that the paper's contrarian-appearing position may not be extremist after all. (shrink)

The purpose of this paper is to explore a new deontic operator for representing what an agent ought to do; the operator is cast against the background of a modal treatment of action developed by Nuel Belnap and Michael Perloff, which itself relies on Arthur Prior's indeterministic tense logic. The analysis developed here of what an agent ought to do is based on a dominance ordering adapted from the decision theoretic study of choice under uncertainty to the present account of (...) action. It is shown that this analysis gives rise to a normal deontic operator, and that the result is superior to an analysis that identifies what an agent ought to do with what it ought to be that the agent does. I discuss a learning outcome of the Western Carolina University, Department of Philosophy and Religion, which focuses on a student’s development and pursuit of a meaningful, thriving, well-lived life, as a corrective to the poverty of existential reflection in the academy. We achieve this Socratic goal via a targeted series of assignments throughout the student’s education, a required pro-seminar on the topic of human flourishing, and other elective courses. The self-reflective, narrative assignments are designed to help students develop their own (...) tentative position on a flourishing life, consider whether and how they are pursuing that vision, and articulate meaningful ways to integrate potential vocations with a fulfilling existence. Students are introduced to these questions in introductory classes; take a pro-seminar analyzing various positions on ‘the good life’ drawn from numerous philosophical, religious, and literary texts, with a research paper assignment critically evaluating one position of their choice ; and, in their final year, revisit their earlier ‘meaning assignments,’ examining retrospectively their academic career and personal development, and prospectively their postbaccalaureate life and career. I conclude with some suggestions for programs keen to incorporate a similar outcome into their own curriculum. (shrink)

Is nature all there is? John Haught examines this question and in doing so addresses a fundamental issue in the dialogue of science with religion. The belief that nature is all there is and that no overall purpose exists in the universe is known broadly as 'naturalism'. Naturalism, in this context, denies the existence of any realities distinct from the natural world and human culture. Since the rise of science in the modern world has had so much influence on (...) naturalism's intellectual acceptance, the author focuses on 'scientific' naturalism and the way in which its defenders are now attempting to put a distance between contemporary thought and humanity's religious traditions. Haught seeks to provide a reasonable, scientifically informed alternative to naturalism. His approach will provide the basis for lively discussion among students, scholars, scientists, theologians and intellectually curious people in general. (shrink)

The worldwide growth of franchising has been phenomenal during the past decade. At the same time there has been increased media attention to questionable business practices in franchising. Similar to some trade associations and professions, franchising has sought self-regulation by developing codes of conduct or ethics. This study examines the codes of ethics covering franchising activities in 21 countries. The results reveal that there is considerable variation in the activities/issues covered by the codes. Specifically, the codes cover most stages of (...) the franchising relationship, focus on a narrow set of stakeholders, are short on ethical guidance, and offer few enforcement provisions. The implications of these findings for international franchising and research are discussed. (shrink)
